Since 13 September 2022, certain contracts concluded by ADAGP to authorise the use of its members’ works can be extended to all authors of the visual arts by the French Ministry of Culture (learn more about extended collective licensing).
Which types of use are covered by this extension?
The law provides for the specific cases in which this type of extended collective licensing may be implemented:
- The exploitation of works in digital form by educational establishments for illustration purposes, as part of their teaching activities (art. L. 122-5-4 of the French Intellectual Property Code) ;
- The exploitation of visual artworks by content-sharing platforms (art. L. 137-2-1 of the French Intellectual Property Code);
- The exploitation of visual artworks in scientific works made available to the public online (art. L. 139-1 of the French Intellectual Property Code).
Who is this measure for?
If you are an ADAGP member and have transferred the management of all your rights, you are entitled to the royalties derived from the extended collective licensing contracts managed by ADAGP, as you would be for any general contract.
If you are a member of another collective management organisation (SAIF, SCAM…), your CMO will collect the royalties you are entitled to on your behalf.
If you are not a member of any collective management organisation, you can:
- contact ADAGP to receive the royalties you are entitled to, and, by joining, receive other rights, participate in the life of the organisation, or apply for grants and endowments.
- complete the form below to object to the inclusion of your works in the scope of the extended collective licensing contract(s) administered by ADAGP, and thus retain the right to control the corresponding uses of your works.
