You want to use an Adagp work on a digital medium ?

The Multimedia Department handles your requests for permission for digital uses and in particular : applications, mobile web applications, internet, slideshows, newsletters and emailings, high definition files intended for the press, interactive DVDs etc..

Catalogue :

Adagp manages the rights of over 110,000 artists who have appointed it to manage their rights. So you can access the reproduction and public communication rights of millions of works. To check if the artist is in the Adagp catalogue, use the interface on tool bar on the right hand-side of your screen.

Permission :

Before reproducing a work from our catalogue, you must obtain our prior permission. To request this, you can use the online form or send us an email at : multimedia@adagp.fr

Royalties :

In return for the permission, you must pay the royalty invoices, whose amounts are calculated according to the extent of use on the basis of the Adagp schedule.

If you are a foreign user, please send your request to our department at multimedia@adagp.fr which, according to the country, will handle it directly or pass it on to the appropriate sister society.

Image Bank :

Adagp also has an Image Bank which you can use to obtain HD (High Definition) files of 25,000 works by 1,700 artists for your projects. To ensure quality images, digital files are checked and validated by Adagp with the artists or their beneficiaries. Adagp Image Bank allows you to obtain a digital image of the work and simultaneously the permission to use it under copyright.

I want to reproduce or broadcast a work from the Adagp catalogue, what do I do ?

You must send us a request for prior permission by using the online form or sending us your request to us at the following address multimedia@adagp.fr. On receipt, Adagp processes your request and grants you official permission, indicating the conditions under which permission is given, for how long, the copyright details and confirming the royalties due.

For certain projects, we have to consult the artist in advance : home page use, detail use, advertising etc, or when a publication is monographic or includes more than 50 works by the same artist. In those cases, Adagp submits the layout of your project to the artist or his/her beneficiaries. This can obviously take some time which we ask you to take into account. So that we can handle your requests as efficiently as possible, please contact us well in advance of your project.

If the artist or his/her beneficiaries are in agreement, we will then grant you permission.

How to prepare your request for permission ?

To be able to handle your application, we need to receive the following information :

- type of organisation,
- address of organisation and contact
- context of use (in particular advertising or corporate communication)
- specify if it involves a detail, montage, overprinting
- monographic publication or not 
- name of the author + title of work (details and different shots of the same work are taken into account)
- duration of use
- medium
- layout (in case of monographic publication, home page, cover, detail)
- definition and resolution of images.

And, according to the medium, the following additional information :

- website : URL, duration of use (with the beginning date)
- application : title, number of downloads, retail price excluding tax
- CD-ROM and DVD-ROM : title, number of copies, retail price excluding tax, please indicate if a work might be on the jacket or cover
- electronic newsletter and invitation : number of emailings, size of the images
- HD file : number and means of availability (reserved access download, by e-mail and/or photo CD) 
- interactive terminal : duration of use, location of terminals

 

By default, for the “internet” medium, definition and resolution are limited to 1600 pixels (width and length cumulated). For any higher resolution, please inform us in advance so we can examine with your technicians if it is possible to increase the definition or resolution using image protection techniques.

I have an agreement for my website, how do I declare the content I have used ?

Adagp provides a reporting form you can download here.

If the content of your data base is so extensive you need to cross-reference data to make your declaration, you can also import a list of our artists by clicking here.

When and on the basis of what amounts will I receive a royalty invoice ?

Invoices are issued after permission has been granted on the basis of our schedule.

Please send us your invoicing address if this is different from the one indicated on the permission.

You must send us the following :

- for digital media: a proof copy 
- for reserved access content: an access code so we can monitor the content and invoice the corresponding amounts.

I am a company wanting to put a large number of works online, what is the procedure ?

Adagp proposes agreements to organisations who want to develop an amount of online content (more than 100 works). The aim of this agreement is to simplify the process to get authorisation. It works on the basis of reporting and not on the basis of requests for prior permission except when the consent of the artist or his/her beneficiaries is required : in the case of adaptation of the work, monographic publication or when a large number of works is required for one artist. The aim is also to allow you to schedule the dates on which content is put online according to your budget.

The cultural organisation I work for wants to put its collections of artworks online, what is the procedure ?

Adagp can propose an appropriate agreement, accompanied with financial terms specific to cultural organisations and corresponding to the extent of your project. The aim of this agreement is to simplify the process for you and it works on the basis of declaration and not on the basis of requests for prior permission except in certain cases when the consent of the artist or his/her beneficiaries is required : in the case of adaptation of the work, monographic publication or when a large number of works is required for one artist. The aim is also to allow you to schedule the dates on which content is put online according to your budget.

Works belonging to the Adagp catalogue have been passed on to me "royalty-free" by a press service, do I have to request permission to use them ?

The statement “royalty-free” is misleading. It is commonly used to indicate the fact that the file containing the visual sent to you is free. However, this does not release you in any way whatsoever from requesting prior permission from Adagp for the reproduction of the work itself. Royalties will be paid for this use to Adagp.

Why do I have to pay reproduction royalties when I've bought the file for the work from a photographic agency / image bank ?

Buying a photographic document on which a copyright protected work is reproduced does not release you from requesting permission from Adagp to reproduce this work. Your purchase only concerns the photographic rights.

Sole Adagp is authorised to manage the reproduction rights relating to the work when the artist or his/her beneficiaries have entrusted their rights to Adagp.

Why do I have to request prior permission and pay royalties to use a work when the owner has given me permission to use it for free ?

You must not confuse the material ownership of a work or a digital file containing the image of this work with the copyrights that are invested in the artist or his/her beneficiaries.

If the work you want to reproduce belongs to the catalogue managed by Adagp, then you will have to contact the Multimedia Department to submit a request for permission.

Royalties will be paid for this use to Adagp, as with all other uses.

Can I obtain a high definition image of the work I want to reproduce ?

Adagp has an Image Bank which currently holds 25,000 images. This collection can be viewed in free access at the following address : bi.adagp.fr.

To ensure quality images, digital files are checked and validated by Adagp with the artists or their beneficiaries.

If you are looking for an artist or a work that you cannot find on the website, do not hesitate to contact us : banque.images@adagp.fr. Our team will try to get the file as soon as possible.

Get permission for use under copyright and the digital image of the work at the same time, remembering that :

- the photographic rights for providing the files will be invoiced to you by the Image Bank Department
- the royalties for the work will be invoiced to you by the departments concerned according to the mode of use

The author of the work I want to reproduce is not French, why do I have to go through Adagp ?

You have to go through Adagp when you are a user based in France and the artist is mentioned in the list of artists managed by Adagp even if he/she is not French. Adagp manages an international catalogue through its reciprocal agency arrangements with almost 50 collecting societies worldwide.
